Potential students often want to know “Can you get a CDL with a DUI?”  The answer is yes, but there may be other obstacles to consider before you start the process. For example, because trucking companies must be able to insure their drivers, a DUI on your record will make you a high-risk driver and therefore more expensive to insure. This can make it difficult to find an employer who is willing to hire you.

How to Get a CDL With a DUI?

The process for getting a CDL with a DUI is the same as without. The only difference is timing. States will require you to have a valid drivers’ license with no suspensions. Suspension times and wait times to get a CDL after a DUI can vary by state. It is best to review your state’s guidelines. In order to get CDL, certain requirements must be met. The following are basic requirements for obtaining a commercial license for the first time:

  • Be at least 18 years old to drive within your state
  • Bet at least 21 years old to drive across state lines
  • Pass a skills test
  • Have a Commercial Learner’s Permit (CLP) for a minimum of 14 days
  • Be a permanent resident of your state
  • Have a valid, unexpired driver’s license in the state you will get a CDL
  • Pass driving background history evaluation
  • Complete an Entry Level Driver Training (ELDT) program 

How Long Do I Have to Wait to Get my CDL with a DUI?

The waiting period to obtain a Commercial Driver’s License (CDL) after a DUI varies significantly by state. Some states impose a mandatory suspension period before you can apply, while others have long-term disqualification rules that can impact your ability to secure employment.

In general, you cannot apply for a CDL while your regular driver’s license is suspended. Once reinstated, you must meet all state requirements before becoming eligible. Missouri DUI Waiting Period for CDL Applicants

In Missouri, a first-time DUI (DWI) results in a mandatory 1-year CDL disqualification. A second DUI offense leads to a lifetime CDL ban, although reinstatement may be possible after 10 years under specific conditions.

  • Before reapplying for a CDL in Missouri, you must:
  • Complete the full disqualification period (1-3 years for first offenses)
  • Satisfy all legal obligations, such as alcohol education programs
  • Pass all CDL exams again, including the written and skills tests

Texas DUI Waiting Period for CDL Applicants

In Texas, the rules are even stricter. A first-time DUI (DWI) leads to a mandatory 1-year CDL suspension. A second offense results in a lifetime CDL disqualification, with no option for reinstatement.

Additionally, Texas law states that even a DUI in a personal vehicle can result in a 1-year CDL suspension, making it one of the toughest states for CDL holders with a DUI on their record.

  • After serving the suspension period, Texas CDL applicants must:
  • Obtain a reinstated personal driver’s license first
  • Pass a background check and CDL knowledge/skills test
  • Meet employer requirements, which often include a 5-10 year waiting period

Because Texas does not allow DUI expungement for CDL holders, many major trucking companies will not hire drivers with a DUI on their record until at least 7-10 years have passed.

Each state has its own laws regarding CDL eligibility after a DUI, and some employers have stricter policies than state regulations. While Missouri offers possible CDL reinstatement after 10 years for repeat offenders, Texas permanently bans CDL drivers after a second DUI.

What Companies Will Hire Me with a DUI?
